Warner Bros. Blocks Release of Asylum's Age of the Hobbits

$

For a long time The Asylum has made its way (for better or worse) into the hearts of movie lovers and haters everywhere by releasing mockbuster after mockbuster after... well... mockbuster. However, Warner Brothers and New Line have just had their latest attempt for second breakfast.

Variety reports that a federal judge has put a halt to plans to release a parody of The Hobbit just days before Warner Bros. and New Line release their first pic in the trilogy of the J.R.R. Tolkien story.

U.S. District Judge Philip Gutierrez issued a temporary restraining order barring Global Asylum Inc.'s "mockbuster" under the title Age of the Hobbits (review), ruling that the project was likely to cause confusion in the marketplace. The judge asserted that Warner Bros. and other plaintiffs (MGM and the Saul Zaentz Co.) were likely to prevail in their claim that the parody infringes on their trademarks.

Gutierrez cited evidence from Nielsen National Research Group showing that about 30% to 40% of respondents "exhibited confusion about the source of 'Age of the Hobbits.'" He noted that, in general, confusion levels of 25% to 50% provide "solid support" for a finding of likelihood of confusion.

Asylum contended that the film's title referred to an ancient Indonesian sub-species and was not intended to relate to Tolkien's fantasy, Gutierrez noted, but he wrote that the terms are not unrelated. Scientists came up with the nickname for the Indonesian sub-species because they resembled Tolkien's characters.

"The release date of December 11 -- three days before the release of 'The Hobbit: An Unexpected Journey' -- provides additional evidence that Asylum intended to profit by associating its film with plaintiffs' work," he wrote.

Gutierrez scheduled a hearing for January 28th to decide if the temporary restraining order should become a preliminary injunction.

Directed by Joseph Lawson, Age of the Hobbits stars Christopher Judge, Bai Ling, Sum Korng, Srogn, and Khom Lyly.

More on The Asylum / Warner Bros. Hobbit Fiasco

$

Curiously enough, even before the recent court ruling suspending the release of The Asylum's latest mockbuster, Age of the Hobbits, Redbox’s website has a listing for the film, slating it for Redbox rental on December 31st.

The “Coming Soon” listing shows the exact same artwork but with the title Clash of the Empires in lieu of Age of the Hobbits. Presumably, that Redbox release with the alternate title will also scrapped due to the court injunction, but as of the time I am writing this, Clash of the Empires is still being listed on Redbox’s website.

Age of the Hobbits (review) may not be the only mockbuster affected by the Warner Brothers lawsuit. The Asylum had just recently announced Jack the Giant Killer starring Jane March and Ben Cross slated for DVD/Blu-ray release on March 12th, around the same time as Bryan Singer’s big budget Jack the Giant Slayer opens in theaters.

A giant beanstalk brings Jack to a land in the clouds filled with snarling, evil beasts. When the creatures make their way to the ground, Jack must figure out how to get back down before they destroy earth and everyone in it.

You may recall that Singer’s film was originally titled Jack the Giant Killer until the studio decided “slayer” sounded less violent than “killer” or something like that. The Asylum’s Jack the Giant Killer has now undergone a name change to simply The Giant Killer. Somehow I doubt it’s a coincidence seeing as how Jack the Giant Slayer is also being distributed by Warner Brothers.

Between this and this past summer’s litigation that forced their Battleship mockbuster American Battleship to change its title, perhaps the Mayans’ predictions of the end of the world in 2012 was really just them predicting the end of The Asylum mockbuster as we’ve come to know it.

Directed by Joseph Lawson, Age of the Hobbits stars Christopher Judge, Bai Ling, Sum Korng, Srogn, and Khom Lyly.

Robert Kirkman Talks The Walking Dead and the Zombie Apocalypse You'll Never See

In terms of the wait for the return of AMC's "The Walking Dead," hours are ticking by like days... days are like years... Simply put, it sucks. And if those damned Mayans are right and the world ends before we can see what happens, I'm busting heads in the afterlife!

In any event, creator Robert Kirkman recently spoke with TV Guide and had some really interesting things to say concerning why we never got to see the zombies take over the world...

“I don’t find that to be interesting at all. In zombie fiction, you see the outbreak, you see the first days and the craziness in almost every other story told in this realm. I’m very proud of the fact that, for the most part, The Walking Dead has skipped over that part. Go watch Zach Snyder’s ‘Dawn of the Dead’ movie to see the early days of this, or ‘Shaun of the Dead’ does it really well.”

Go House Hunting with the Beastmaster this March

Go House Hunting with the Beastmaster this MarchThe American dream once again becomes the American scream when two families looking to buy a new home attend an open house only to find themselves trapped in a hellish nightmare unleashed by the wrathful spirit of the original owner.

This sounds like a job for Dar the Beastmaster… I mean Marc Singer!

Marc Singer, Janey Gioiosa, Hayley DuMond, Paul McGill, Rebekah Kennedy, Victoria Vance and Art LaFleur star in Eric Hurt’s House Hunting, the new horror movie in which it isn’t just the house that’s condemned.

If the American dream for most families is buying a house, then for the two families headed to what they think is a simple open house, their dream is about to become a nightmare. We meet our two very different families as they search for the perfect house to call a home. When both families show up at the deserted farmhouse, it quickly becomes clear that something is not right. After finding a terrified girl in the woods, and discovering that every attempt to leave the farm takes them right back to its front door, the horror of the situation sets in.

Stuck in this purgatory together for days, they’re haunted by a vengeful former owner bent on destroying them from within with the simple declaration that only one family will call the house a home. As the days stack up and the families search in vain for a way out, the group dynamics dissolve into chaos. The acres of bare woods and fields stretching out from the house become a maddening prison they must endure until one family can ultimately overcome the other and call the house a home.

Phase 4 Films will put this real estate on the market on March 5th.

See Man-eating Giants Attack on Titan in this First Trailer

We’ve become accustomed to movies and TV shows about post-apocalyptic survivors huddled in locations fortified to keep out whatever undead, mutant, or extraterrestrial threat there is. In "Attack on Titan" the threat comes in the form of giants… man-eating giants!

Probably should mention right now that "Attack on Titan" is anime. I didn’t mention that little tidbit in the introductory paragraph because some of you wouldn’t have bothered to click on it to find out more. Some people just don’t like anime. Me personally? I was huge into anime up until the immediate post-Evangelion period when all new anime seemed to go out of its way to be joyless, slow-paced, existential tripe. “Attack on Titan” looks like a TV show that could get me watching again.

Wit Studio, Production IG, and “Highschool of the Dead” director Araki Tetsuro are behind this new series based on Isayama Hajime’s award-winning manga premiering on Japanese television in early 2013. “Attack on Titan” centers on a brother and sister living in a world where the remains of the human population live inside cities surrounded by enormous walls due to the sudden appearance of the Titans, gigantic humanoids who devour humans seemingly without reason.

A one-minute teaser for the “Attack on Titan” series has arrived. I’m curious as to why some of the Titans look like giant humans and one looks like The Amazing Colossal Man sans skin.

A live-action movie version from director Tetsuya Nakashima (Confessions, Kamikaze Girls) is supposedly in the planning stages already.
